Lee A. McCoy - Attorney and Founder

Mr. McCoy has been an attorney in southern California for more than fifteen years. He began his practice as an appellate lawyer with the 350-lawyer international firm Thelen, Marrin, Johnson & Bridges, where he was amicus counsel before the California Supreme Court in the landmark decision Mitchell v. Gonzales.

The research and writing experience as an appellate lawyer has proven invaluable in the practice of criminal defense. The law of drinking/driving is a science-based discipline; a competent attorney must be comfortable researching scientific concepts and legal doctrines. Mr. McCoy's recent appellate victory in Nazerian v. DMV changed DUI law on the central coast by forcing DMV to recognize the margin of error in breath test machines. In so-called "Zero Tolerance" cases involving drivers under age 21, Nazerian requires a breath test reading of 0.02 instead of the 0.01 stated in the California statute.

Education

Mr. McCoy received his bachelor's degree in liberal arts from the University of Illinois at Urbana-Champaign, and he earned his Juris Doctor from the University of Illinois College of Law. During law school, Mr. McCoy served as Notes Editor and later Topics Editor for the Illinois Bar Journal and as a law clerk to Professor Richard L. Marcus.

DUI Seminars & Training

Mr. McCoy is the only attorney in central California to have been graduated from the National College for DUI Defense Course at Harvard Law School, and one of only three California attorneys to have graduated from the Robert F. Borkenstein Alcohol & Highway Safety Course at Indiana University.

Mr. McCoy is an Instructor of the Standardized Field Sobriety Tests trained by the National Highway Traffic Safety Administration and the International Association of Chiefs of Police. His training exceeds that of most law enforcement officers making DUI arrests in all fifty states, and as an Instructor, he has taught the NHTSA SFST curriculum to investigators, toxicologists and attorneys. Mr. McCoy is also the principal California SFST Instructor for the Lorman Education Services series of legal seminars.

Mr. McCoy is certified in the operation of the Draeger breath testing instruments (the "7110" and the "7410 EPAS") and the Alco-sensor preliminary breath test machine manufactured by Intoximeters.

Faculty Positions

Mr. McCoy is also the only DUI attorney in the State of California to be an active Professor of Law, teaching Criminal Procedure, Drinking/Driving Law and Appellate Law/Procedure in Santa Barbara and Ventura. In 2003-2004 he was voted Professor of the Year by his students.
